CZK: Public call for lease of business premises
On the basis of Articles 39 and 40 of the Law on State Property (SI. List of Montenegro No. 21/9), Articles 29-32 of the Decree on the Sale and Leasing of Things in State Property (SI. List of Montenegro No. 44/10) , director of the Rožaje Center for Culture publishes,
PUBLIC CALL
for leasing office space
1. Subject of the invitation: Office space on the ground floor of the building Ju Center for Culture Rožaje, surface 196.40 m2 .
2. Purpose: Business activities, service activities (excluding catering services that serve alcohol).
3. Lease term: Five (5) years, with the possibility of extension, provided that the tenant properly services all his obligations (rent, electricity, utilities, water supply and sewerage, etc.)
4. Initial amount of rent: €7 per m2 usable area per month.
The deadline for submitting written offers is eight (8) days from the date of publication of the Public Invitation, i.e. from November 25, 2019 to December 3, 2019. from 11 a.m. to 2 p.m., office no. 14. building JU Center for Culture Rožaje.
All legal and natural persons can submit an application for public bidding.
The public invitation will be published on the Rožaje Center for Culture website and through public media.
Participants of the public call are required to submit the following documentation:
- legal entities: name and seat of the participant, confirmation that the legal entity is active, extract from the Central Register of the Commercial Court, confirmation that the legal entity is not in bankruptcy and liquidation proceedings, confirmation that all tax obligations have been settled within 30 days before the public tender, authorisation-midnight to participate in the public tender, all documents must not be older than 6 months.
- physical ID: first and last name, residential address, certified copy of ID card or passport, confirmation that no criminal proceedings are being conducted against the person (issued by the Basic Court), authorization-power of attorney to participate in public bidding if represented by another natural person.
The offer must contain the amount of monthly rent offered for m2• Proof of payment of a deposit in the amount of four (4) months' rent of the leased space.
Account number with an indication of the commercial bank where it was opened, for the return of the deposit.
The offer must be signed and stamped (for legal entities) by a natural person or an authorized person for legal entities. The deposit of the bidder who is not selected will be returned, and the deposit whose bid is accepted will be kept and charged to the rent. To the extent that the selected bidder withdraws from the contract for the lease of business premises after the selection has been made, he/she will lose the right to refund the deposit.
The most favorable offer will be considered to be the one that, in addition to the exclusive fulfillment of all bidding conditions, with the accompanying trazenor documentation, also contains the highest amount of rent.
The public opening of bids will be carried out by a commission appointed by the director of the Rožaje Center for Culture on December 3, 2019. at 2:00 p.m. in office no. 14 of the JU Center for Culture Rozaje building. Bid opening can be attended by bidders or authorized representatives of bidders.
Bidders will be informed about the result of the bidding within three (3) days from the day of the identification of the most favorable bidder for the mentioned business premises.
Unsatisfied bidders have the right to complain to the director of the Rozaje Center for Culture, within five (S) days from the date of receipt of the decision, if they believe that the office space was leased to a natural or legal person who does not meet the bidding conditions or believes that the procedure is not correct implemented.
With the selected bidder, the director of the Rožaje Cultural Center will conclude a contract for the lease of office space in four (4) identical copies, two (2) copies for each.
The office space is given in the condition in which it was seen, and the reconstruction and adaptation that is carried out (interior and exterior) in order to improve the functionality as a whole is borne by the user with the consent of the committee appointed by the director of the JU Center for Culture Rožaje, without the right to return the invested funds.
