Public invitation for mutual termination of employment with payment of severance pay

Based on Article 33 paragraph 3 of the Law on Salaries of Employees in the Public Sector ("Official Gazette of Montenegro", No. 16/16, 83/16, 21/17, 42/17, 12/18, 39/18, 42/18 and 34/19) and the Decision on severance pay in case of mutual termination of employment of employees in the public sector (Official Gazette of Montenegro No. 41/19), and in connection with the Conclusion of the Government of Montenegro No. 07-3038 of July 11, 2019, the President of the Municipality of Rožaje announces:

PUBLIC CALL
for the mutual termination of the employment relationship with the payment of severance pay

  1. All employees in the local administration bodies and services of the municipality of Rožaje, who have at least six years of service, of which the last year in the municipality of Rožaje, and who are interested in a mutual termination of employment with the payment of severance pay, are invited to, by August 30, 2019 submit to the head of their authority a request for mutual termination of the employment relationship with payment of severance pay.
  2. An employee can exercise the right to severance pay in the amount of up to 50% of monthly gross salary for each year of service, with the severance pay amount not exceeding 15% of the employee's gross salary.
  3. An employee who fulfills the conditions for retirement and if he is up to two years away from reaching the age of 67, can exercise the right to severance pay in the amount of up to six gross earnings.
  4. The amount of gross earnings is determined as the average amount of the last three gross earnings that belonged to the employee before the payment of severance pay.
  5. Straješina will decide on the request of the interested employee by September 30, 2019.
  6. The employee's employment ends on the day the severance pay is paid.
  7. An employee whose employment relationship is terminated on the basis of a written agreement, i.e. a consensual termination of employment relationship, and who exercises the right to severance pay, cannot establish an employment relationship in the public sector, including all institutions, legal entities and companies covered by Article 41 of the Law on Salaries of Employees in the Public Sector, within a period of five years from the date of mutual termination of the employment relationship.
  8. The restriction from point 7 of this call does not apply to an employee who returns the entire amount of paid severance pay.
